Driver, 90, charged with misdemeanor in pedestrian death

Police have identified the pedestrian who died Monday in Kill Devil Hills as Robert A. Rawlings, 82, of Weirton, W.Va.

Rawlings was crossing U.S. 158 at West Landing Road when he was hit by a pickup driven by Harvey L. Sourbeer, 90, of Point Harbor in Currituck County. A friend tried unsuccessfully to pull him out of the way of the oncoming Chevrolet Silverado.

Sourbeer has been charged with misdemeanor death by motor vehicle and was placed under a $10,000 unsecured bond, a Kill Devil Hills Police Department statement said.

“To be clear, since there’s been some confusion in the public reaction to this incident, Mr. Rawlings was in no way shape or form at fault for what happened. He was crossing the road in properly marked crosswalk,” Capt. J.C. Towler Jr. said in the statement.

“The light was green for him to cross and the light was functioning properly. He had the right of way. Those are the pertinent facts surrounding the circumstances of the collision.”

The statement included the section of state law regarding felony and misdemeanor death by vehicle. Read it here »

Thanks for the article. Just a bit of feedback here: links (like the one you have to pdf of n.c.g.s) should open to new window/tab so the user can stay with OBV article as well. Shouldn’t be too difficult if you’re using wordpress.
